These are the terms you agree to when you use ChatVia. They exist to keep both of us safe and to make clear what you can expect from us and what we expect from you.
1. Acceptance
By creating a ChatVia account or using the ChatVia apps or website, you agree to these Terms and our Privacy Policy. If you don't, please don't use the service.
2. The service
ChatVia is a messaging service available on macOS, Windows, Android, iOS, and the web. The service is free to use; there is no paid tier today.
We may change, suspend, or discontinue any part of the service at any time. If we shut something down that you depend on, we'll give you reasonable notice and a way to export your data.
3. Your account
You're responsible for keeping your account secure. That includes not sharing your password and not letting other people sign in as you. If you suspect your account is compromised, sign out from every device in Settings and contact security@chatvia.in.
You must be at least 13 years old (16 in the European Union) to create an account.
4. Acceptable use
You may not use ChatVia to:
- Harass, threaten, or abuse other people.
- Share child sexual abuse material. We will report this to the relevant authorities and immediately delete the account.
- Distribute malware or attempt to compromise other users' accounts or devices.
- Violate any law applicable in your jurisdiction or ours.
- Reverse engineer the service, or use it to build a competing product.
We don't monitor the content of your messages, so we generally can't see misuse on our own. We rely on reports from the people in a conversation. (At v1.0, end-to-end encryption will make message content technically unreadable to us entirely.) When a credible report arrives, we may suspend or terminate the reported account.
5. Intellectual property
You own what you send. By sending it, you give us the limited right to store it in encrypted form so we can deliver it to its recipient(s).
The ChatVia name, logo, brand, and source code are ours. ChatVia is licensed to you for use, not ownership; you may not copy, resell, or redistribute the app or its code.
6. Termination
You can delete your account anytime from Settings or by emailing privacy@chatvia.in. Deletion is permanent.
We may suspend or terminate accounts that violate these Terms, with notice when reasonably possible.
7. Disclaimer
The service is provided "as is" and "as available," without warranties of any kind, express or implied. We do our best to keep it running and secure, but we can't promise uninterrupted operation or that every message will arrive instantly.
8. Limitation of liability
To the maximum extent permitted by law, ChatVia is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability for any claim related to ChatVia is limited to the amount you've paid us for the service in the prior twelve months (which is zero, since the service is free).
9. Governing law
These Terms are governed by the laws of India. Disputes will be resolved in the courts of Mumbai.
10. Changes
We may update these Terms occasionally. If we make material changes, we'll notify you in-app and by email at least 30 days before they take effect.
